Terms of Service
These terms are an agreement between you and Lomeda (“Lomeda”, “we”, “us”) and govern your use of the Lomeda app, the lomeda.app website and related services (together, the “Service”). By creating an account, joining the waitlist or otherwise using the Service, you agree to these terms. If you do not agree, please do not use the Service.
1. Who can use Lomeda
You must be at least 16 years old to use the Service. By using it, you confirm that you are 16 or older and able to enter into a binding agreement. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these terms for it.
2. Your account
You need an account for some features. Give us accurate information, keep your password secure, and do not share your account. You are responsible for activity under your account; tell us promptly at hello@lomeda.app if you believe it has been used without your permission. You can ask us to delete your account at any time.
3. The Service and early access
Lomeda helps you learn languages from real content: reading, listening, looking up words, and practising with flashcards. The Service is in early access. Features may be added, changed or removed, may be unavailable at times, and may contain errors. We may stop offering some or all of the Service; where reasonably possible we will give you notice and a way to request a copy of your data first.
Joining the waitlist does not guarantee access to the app, to early testing, or to any particular feature or price.
4. Your content
“Your content” means the photos, scans, text, audio and other material you add to the Service, and the lessons and flashcards made from it. You keep all rights you have in your content.
You give Lomeda a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, translate, display and create derivative learning materials from your content, only as needed to provide the Service to you and to keep it secure. This includes sending it to the service providers described in our Privacy Policy. The licence ends when you delete the content or your account, except for copies we must keep by law or that remain in backups for a limited time.
You are responsible for your content. You confirm that you have the right to use it in this way — for example, that copying a page from a book or article for your own study is permitted where you live — and that it does not infringe anyone’s rights or break the law. Your content is private to your account; the Service does not publish it.
5. AI-generated content
Translations, explanations, recognised text, example images and audio are produced automatically, in part by third-party AI services. They can be inaccurate, incomplete or inappropriate, and similar output may be given to other users. Use them as a learning aid, not as a professional translation or as legal, medical, financial or other professional advice. Check anything important with a reliable source. Subject to these terms, you may use the output generated for you for your personal learning.
6. Library content and our rights
The Service, including its software, design, logos, the Lomeda name, and the books, articles, illustrations and audio in the Lomeda library, is owned by Lomeda or its licensors and protected by intellectual property law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service and the library for your own non-commercial learning, in line with these terms. Some library works are in the public domain; their illustrations, adaptations and recordings may not be.
If you send us feedback or suggestions, we may use them without any obligation to you.
7. Acceptable use
You agree not to:
- break the law, or infringe anyone’s intellectual property, privacy or other rights;
- add content that is illegal, sexually exploits minors, promotes violence or hatred, or that you have no right to use;
- copy, resell, redistribute or publicly share library content or other parts of the Service, except as the law allows;
- reverse engineer, decompile or try to extract the source code of the app, except where the law permits this despite this restriction;
- access the Service by automated means, scrape it, or use it to build a competing product or train AI models;
- get around usage limits, security measures or App Check, or interfere with or overload the Service;
- impersonate anyone or misrepresent your connection with anyone;
- use another person’s account, or help anyone else do any of the above.
8. Usage limits and fees
The Service is currently free. To keep it available for everyone, some features have fair-use limits, such as a daily number of scanned pages or amount of read-aloud audio, which may change over time.
We may introduce paid plans in the future. We will not charge you without telling you the price and terms in advance and getting your agreement. Purchases made through the App Store or Google Play are also subject to those stores’ terms, including their refund policies, and nothing in these terms limits any right of withdrawal you have under consumer law.
9. Third-party services
The Service relies on third-party services, such as Google sign-in, cloud and AI providers, and the app stores. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for them. If you downloaded the app from the Apple App Store, the “Apple” section below also applies.
Apple
These terms are between you and Lomeda, not Apple. Apple is not responsible for the app, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app, including product liability, legal compliance or intellectual property claims. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
10. Suspension and termination
You can stop using the Service at any time and ask us to delete your account. We may suspend or end your access if you seriously or repeatedly break these terms, if we must do so by law, or if your use creates a risk for other users or for Lomeda. Where appropriate we will tell you why and give you a chance to respond first. If we end the Service or your account for reasons other than your breach, we will give you reasonable notice so you can request a copy of your data. Sections that by their nature should continue — including sections 4 to 6 and 11 to 16 — survive termination.
11. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise any particular learning result.
If you are a consumer, you have legal rights in your country that these terms cannot change, such as statutory guarantees for digital content and services in the EU and the UK. Nothing in these terms affects those rights.
12. Limitation of liability
To the extent permitted by law, Lomeda is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 50 euros (or the equivalent in your currency).
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or, where applicable law provides, for gross negligence or wilful misconduct. If you live in the EU or the UK, we are responsible for foreseeable loss caused by our breach of these terms or our failure to use reasonable care and skill.
13. Indemnity
To the extent permitted by law, and except where you use the Service as a consumer in a country whose law does not allow it, you agree to compensate Lomeda for reasonable losses and costs, including legal fees, arising from third-party claims caused by your content or your breach of these terms.
14. Governing law and disputes
Please contact us first at hello@lomeda.app — most concerns can be resolved quickly and informally.
These terms are governed by the laws of the country (and, in the United States, the state) where you normally live, and you may bring proceedings in the courts of that place. In particular:
- EEA, UK and Switzerland: you keep the protection of the mandatory consumer law of your country of residence and may bring claims in its courts. EU consumers can also use an out-of-court alternative dispute resolution body.
- United States: any claim must be brought individually and not as a plaintiff or class member in a class or representative action, to the extent permitted by law.
- Israel: these terms are subject to the Israeli Consumer Protection Law, and disputes may be brought before the competent courts in Israel.
- Elsewhere: the mandatory law and courts of your country of residence apply.
15. Changes to these terms
We may update these terms, for example when we change features or when the law changes. We will change the “Last updated” date and, for significant changes, notify you in the app or by email at least 30 days before they take effect, unless a change is required sooner by law or to address a security risk. If you do not agree to the changes, you can stop using the Service and delete your account before they take effect.
16. General
These terms and our Privacy Policy are the whole agreement between you and Lomeda about the Service. If a provision is found unenforceable, the rest remains in effect. If we do not enforce a provision, we have not waived it. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a merger, acquisition or sale of assets, provided this does not reduce your rights. If these terms are available in several languages and the versions differ, the English version prevails, except where the law of your country requires otherwise.
